II. CONDITIONS OF USE
1. Introduction. Newblue offers and markets tourism services, which can be contracted directly online only by Travel Agencies and Tour Operators. By accessing and using this website, you agree to be bound by the conditions set out below, so you are encouraged to read this section carefully before you begin your browsing.
2. Obligations of Users. Users undertake to use this Website lawfully, in accordance with the provisions of these conditions and in such a way as not to prejudice the rights or interests of Newblue or of third parties. By way of example and under no circumstances by way of limitation or exclusion, the User also undertakes to:
Not engage in illegal activities or those which are against public order or good faith;
Not attempt to access, modify, manipulate and, where appropriate, use the accounts of other Users;
Not use the data published on the Website for the sending of unsolicited communications (spam).
Not introduce or disseminate false, misleading, ambiguous or inaccurate information or content on the website in a way that misleads the recipients of the information, nor to disseminate content of a racist, xenophobic, pornographic nature, or that which supports terrorism or breaches human rights or the rights of children;
Not take actions that involve or lead to a violation of the intellectual property rights of Newblue or of third parties;
Not cause damage to Newblue’s physical and logical systems, or those of its suppliers or third parties;

3. Disclaimer .This Website is provided “as is” and its use is at the User’s own risk, so neither Newblue, nor its administrators, workers, suppliers or employees will be liable for damages of any nature, direct or not, arising from the use of the Website, explicitly excluding Newblue, to the full extent provided by Law, from any kind of guarantees, whether explicit or implicit.
Newblue does not guarantee the availability and accessibility of the Website, but will make all reasonable efforts to do so. On occasion, interruptions may occur for as long as necessary to carry out the corresponding maintenance operations.
Newblue is not liable for any damage resulting from interference, interruptions, computer viruses, telephone breakdowns or telephone disconnections arising from causes beyond the aforementioned entity’s control; for delays or blockages in the use of this electronic system caused by deficiencies or overloads in the data processing centre, on phone lines, on the Internet or other electrical systems; or for any other alterations that may occur in Users’ Software or Hardware. Nor shall Newblue be liable for any damages caused by the use or misuse of the contents of the Website, or for any consequences that may arise from errors, defects or omissions in the contents that may appear on this Website provided by the Users themselves or other third parties. Newblue assumes no obligation or liability with respect to those services that it does not provide directly.
4. External Links. Newblue shall not under any circumstances be liable for the contents of any links belonging to any third party website, nor shall it guarantee the technical availability, quality, reliability, accuracy, breadth, truthfulness, validity and legality of any material or information contained in any such hyperlinks or other Internet sites. Likewise, the inclusion of these external connections will not imply any kind of association, merger or participation with the connected entities.
